1.  About Print Subscriptions

1.1  Print Subscriptions to The Sydney Morning Herald are valid in NSW, ACT and parts of South East Queensland where normal home delivery exists. For information on delivery outside of these areas, please call Customer Service on 13 66 66. Delivery to addresses within security apartments or office buildings is subject to delivery capability. A Print Subscription may be discontinued with notice to the Customer (with a pro-rata refund if applicable) where distribution services cease to be available.

1.2  Subscribers of The Sydney Morning Herald in non-metro will not receive The Sydney Magazine and may not receive the MyCareer or Domain sections of The Sydney Morning Herald on Saturdays.

1.3  With any home delivery of The Sydney Morning Herald the delivery of any promotional items is not guaranteed.

2.  Processing and Payment (including Grace Periods)

2.1  Nine Entertainment will process your Print Subscription purchase as promptly as possible. You payment details must be verified before your Print Subscription can be activated. This may take up to 10 days to process.

2.2  If your initial payment authorisation is revoked, your Print Subscription will be terminated. We reserve the right to reject any subscription order or purchase at any time.

2.3  Grace Period for Direct Debit Subscriptions. If we are unable to debit your account for any reason, we will notify you that you have 14 days to rectify your account in order to prevent your Direct Debit Subscription being cancelled. Your subscription will continue during the 14 day grace period. You may be required to clear any unpaid subscription fees, and reimburse us for any transaction fees that we incur as a result of a failed direct debit transaction, as a condition of continuing your subscription.


3.  Pricing

3.1  Prices quoted for Subscriptions are in Australian dollars and are GST-inclusive.

3.2  Direct Debit Subscriptions:
Deductions will be made from your nominated bank account either:
(a) every 4 weeks in advance of your Print delivery and/or Digital Edition access, or
(b) every 13 weeks in advance of your Print delivery and/or Digital Edition access.
You acknowledge that subscription prices for Direct Debit Subscriptions may be changed by Nine Entertainment from time to time by giving you at least 14 days' written notice in advance.
Price changes will take effect from your next billing date after the notice period.
If you do not wish to continue your Direct Debit Subscription at the revised price, you may cancel your subscription by contacting Subscriber Services 72 hours before the end of your current direct debit pay cycle (either 4 or 13 weeks).
The authority to debit your account every 4 weeks or 13 weeks (as applicable) remains valid until you notify Nine Entertainment that you wish to cancel your Direct Debit Subscription by contacting Subscriber Services.
Subscription cancellation will be effective at the end of our current direct debit pay cycle (either 4 or 13 weeks).
IT IS YOUR RESPONSIBILITY TO NOTIFY US IF YOUR DIRECT DEBIT BANK ACCOUNT IS CANCELLED OR IF YOUR BANK ACCOUNT DETAILS CHANGE BEFORE YOUR NEXT BILLING DATE.

3.3  Upfront Subscriptions:
The full, fixed term payment is due upfront and is payable by cheque, money order or credit card. At the end of the subscription term Nine Entertainment may contact you in order to renew your subscription, alternatively you may contact Subscriber Services in order to renew your subscription at any time.
If you choose to pay by BPay, please ensure the full payment is paid upfront. You should allow 5 working days for BPay payments to be processed.
Nine Entertainment reserves the right to change the duration of the Upfront Subscriptions and the pricing of Upfront Subscriptions offered from time to time.
For the avoidance of doubt, the price of your Upfront Subscription cannot be changed by Nine Entertainment during the applicable term.


4.  Promotions

4.1  Nine Entertainment may at times offer special promotional offers. The specific terms and conditions of each promotion will be clearly stated at the time of the promotion and will apply in addition to these Home Delivery Subscription Terms and Conditions.

4.2  In the event of any inconsistency between the terms and conditions of a special offer and these Home Delivery Subscription Terms and Conditions, these Home Delivery Subscription Terms and Conditions will apply.

4.3  You may be required to provide your payment details when you sign up for a promotion. If this is a direct debit offer, your subscription will be automatically renewed after your initial payment at the standard subscription rate unless you cancel under the terms of the cancellation policy (see clause 8 below).

4.4  With any home delivery of The Sydney Morning Herald the delivery of any promotional items is not guaranteed.


5.  Modifying Print Subscriptions

Print Subscriptions and the Print Subscription component of the Print-Digital Edition Subscription Package.

5.1  If at any point you wish to have your newspaper redirected to a new address within a deliverable area, you will need to contact Subscriber Services.

5.2  Your Print Subscription delivery address can be changed by giving Nine Entertainment at least 2 business days' notice.

5.3  A temporary address re-direction of your Print Subscription to a new address is permitted only for a period of 14 days or more.

5.4  You are able to change the type of your Subscription (for example, from Print to Print+ Digital Edition) once prior to the expiry of your current subscription term. If you choose to change subscription types, the balance of the amount paid in advance for your current subscription will be applied to the cost of your new subscription on a pro-rata basis.


6.  Modifying Digital Edition Subscriptions

This clause 6 applies to Digital Edition Subscriptions and to the Digital Edition Subscription component of your Print-Digital Edition Subscription Package.

6.1  Digital Edition Subscriptions cannot be temporarily suspended under any circumstances.

6.2  Digital Edition Subscriptions cannot be redirected to a different user.

6.3  Your Digital Edition username and password cannot be provided to someone else.

6.4  If you experience technical problems accessing your Digital Edition Subscription, it is your responsibility to notify Subscriber Services to receive assistance.

6.5  You are able to change the type of your Subscription from a Digital Edition only package to a Print inclusive of Digital Edition access only once prior to the expiry of your current subscription term.

6.6  If you choose to change subscription type, the balance of the amount paid in advance for your current subscription will be applied to the cost of your new subscription on a pro-rata basis.


7.  Cancellations and Suspensions

7.1  You can cancel your subscription at any time by contacting Subscriber Services:

7.2  Direct Debit subscriptions are non-refundable. When you cancel, you cancel only future charges associated with your subscription. Minimum subscription terms may apply to select Direct Debit Subscriptions. The applicable minimum term will be specified in the terms and conditions that accompany the subscription offer. Where a minimum term applies, a cancellation fee may be charged if the subscription is cancelled by you within the minimum term. This is due to administrative costs incurred in processing a cancellation.
When cancelled the subscription will simply expire at the end of the 4 week or 13 week period (as applicable) for which payment has already been debited and no further debits will be made once notice of cancellation is received.

7.3  Upfront Subscriptions: A cancellation fee may apply to Upfront Subscriptions cancelled prior to expiry of the applicable term. This is due to administrative costs incurred in processing a cancellation. A $25 cancellation fee may apply to any subscription of 4 days or less per week. A $50 cancellation fee may apply to a subscription of 5 days or more per week. A pro-rata refund of the balance of the term of your Upfront Subscription will be provided, less the cancellation fee, except in the following cases:

7.4  In the event of a cancellation of your Print Subscription by you or Nine Entertainment as a result of ongoing major delivery problems or non-delivery within your area (being NSW or ACT for The Sydney Morning Herald only), no cancellation fee will apply.

7.5  If you have a Print subscription that includes access to the Digital Edition and you cancel that Print subscription, access to the Digital Edition component will cease on the same day that the Print Subscription component ceases to be delivered.

7.6  Nine Entertainment reserves the right to suspend or cancel your subscription at any time in its absolute discretion, provided that Nine Entertainment gives you written notice of such suspension or cancellation. In the event that Nine Entertainment cancels your subscription, you will receive a pro-rata refund for the balance of the term on your Upfront Subscription.

7.7  You are permitted to suspend home delivery of your Print Subscription. Delivery will not be made during any suspension period notified to Nine Entertainment. However, the expiry date of your Upfront Subscription will not be extended and you will not be entitled to any refund in respect of the suspension period. For Direct Debit subscriptions, payments will continue to be deducted as per your pay cycle (every 4 or 13 weeks) during the suspension period.


8.  Your Privacy

8.1  You agree that your name, address, email address and telephone number will be collected and stored by Nine Entertainment and used for the purposes of fulfilling your subscription, communicating with you about your subscription and to notify you of any associated Customer offers or benefits or future subscriptions, unless otherwise notified by you.

9.  Benefits Program

As a Subscriber, you may be eligible to participate in a Benefits Program.

9.1  For subscribers of The Sydney Morning Herald, Terms and Conditions for this program are available at smh.com.au/forsubscribers.


10.  Disclaimers

10.1  You agree that any errors made in entering your contact information and order details are your responsibility and Nine Entertainment is not liable for any consequences that may arise as a result of such errors or incorrect information, including but not limited to sending the subscription to the address as notified by you. If you change your address or any other relevant details or do not receive your subscription, you should notify Nine Entertainment by calling Subscriber Services.

10.2  To the extent permitted by law, Nine Entertainment is not liable to you for any loss or damage incurred by you in connection with your subscription, whether direct, consequential, special, indirect or other loss or damage. In any event, Nine Entertainment's maximum liability to you is limited to the value of the subscription fees paid within the previous twelve months.


11.  General

11.1  You acknowledge and agree that you are entitled to purchase a subscription from Nine Entertainment for personal use only. You agree and acknowledge that subscriptions cannot be exploited for any commercial purpose, including on-selling your subscription to any third party. Despite this, Nine Entertainment may, at its sole discretion, offer multiple copy subscriptions to certain organisations. Such corporate subscriptions can be arranged by contacting Subscriber Services directly.

11.2  You agree that all subscriptions provided, benefits accepted or offers made by Nine Entertainment shall be deemed to be provided in Australia, notwithstanding your location, and the terms of such subscriptions, benefits and offers shall be governed exclusively by New South Wales law, and the Courts of New South Wales shall have exclusive jurisdiction to determine any such matters that may arise involving or alleged to involve Nine Entertainment.

11.3  You acknowledge that these Subscription Terms and Conditions may be modified by Nine Entertainment from time to time, including but not limited to terms relating to fees and charges, cancellation and changing subscriptions. Changes to these Subscriptions Terms and Conditions will be notified on Nine Entertainment's Subscription Website www.subscribe.smh.com.au for The Sydney Morning Herald) and by email, where you have provided a valid email address. You agree that you are responsible for regularly reviewing these Subscription Terms and Conditions and your continued use of the subscription constitutes your acceptance of any such modifications. Subject to clause 2.3, this clause applies to Direct Debit Subscriptions and Upfront Subscriptions.

11.4  From time to time Nine Entertainment offers promotional items with its newspapers. Nine Entertainment does not guarantee that newspapers delivered to Subscribers will include these items. From time to time, these items will be available for collection at a newsagency or Nine Entertainment's offices. At its discretion Nine Entertainment will communicate with its Subscribers about the availability of such items.


12.  DEFINITIONS

In these terms and conditions:

12.1  "Nine Entertainment", "we" or "us" means Nine Entertainment Co. Pty Limited, publisher of The Sydney Morning Herald.

12.2  "Subscriber", "Customer" or "You" means a person who is a subscriber to The Sydney Morning Herald.

12.3  A "Print Subscription" means a standard fully paid Sydney Morning Herald subscription taken up directly with Nine Entertainment, and for which these terms and conditions apply. A Print Subscription includes all parts and sections of the publication deemed part of the publication for home delivery in your area; this may change from time to time in accordance with Nine Entertainment's reasonable logistics and operational requirements. A Print Subscription may be made by direct debit which is an ongoing subscription where Nine Entertainment debits the cost of the subscription from Your bank account every 4 weeks or 13 weeks ("Direct Debit Subscription"), or a fixed term subscription where the full payment is made by You upfront ("Upfront Subscription").

12.4  A "Digital Subscription" means a paid subscription to The Sydney Morning Herald Digital Edition.
